National Court

1. The court had received a written submission from the two drivers of Car 10- Ian Wilson and Elliot Wilson, who were a father and son team, and heard evidence from the Britcar Championship Co-ordinator, Claire Hedley.
2. There was no Challenge to the basic facts of the case. These can be simply stated. Car 10 was a multiple driver entry; CR 2.4.5 applies and therefore no one driver should drive for more than 60 per cent of the race time. Elliot Wilson drove for circa 81 per cent of the race time.
3. In mitigation Ian and Elliot Wilson submitted that during 2025 they had corresponded with both Claire Hedley and David Hornsey, the Technical Manager for Britcar, on the subject of CR 2.4.5. They had believed that as the regulation had been introduced to prevent teams using a professional driver to do most of the driving in a pairing, it could operate to the disadvantage of multi driver teams where no professional driver was used. They had further believed that the regulation no longer applied in 2026. would satisfactorily answer items 2 and 3 of the terms of reference of the Inquiry.
7. On this basis the Court imposes a total time penalty of 210 seconds on Car 10. The Results should be amended and re-published accordingly.
8. It is inappropriate to make any orders as to costs.

5. CR Art 4.2R provides that the penalty for exceeding Maximum Driver Time is a 180 second stop-go penalty. For reasons that remain unclear the timekeepers at the event do not appear to have notified the Clerk of the Course about the apparent irregularity and consequently the issue was not dealt with during the event or at the circuit. The penalty was therefore not imposed.
6. The Court is mindful of NCR Ch. 12 App10. Art. 2.1. L which provides that where a stop / go penalty cannot be imposed for operational reasons an alternative penalty of no less than 30 seconds and no more than one minute shall be added to any penalty period and the elapsed time of the vehicle involved. As the Court has the clear authority to impose a time penalty this
