DECISION
4. The Court accepts the representations made by both Miss Franklin and Mr Bamber in that the Stewards heard the matter in the unsurprising absence of Tyler Read, having quite failed to give him notice of the Appeal and its Hearing.
5. The Court accordingly Orders that the Decision of the Stewards of the meeting at Brands Hatch on 7th June this year made in response to the Appeal of John Mickel be set aside in its entirety, that the results of the race in question be recast and re-issued with appropriate reordering of Championship points.
6. The various deficiencies in the terms of the Stewards’ actual Decision addressed by Miss Franklin are also noted, in particular the incorrect imposition of penalty points for this offence from which a greater harm would have arisen by virtue of the Championship Regulations applying a multiple to that number of points and deducting the resultant figure from Read’ s Championship points.
7. The Court does not, however, agree with Miss Franklin’ s assertion that Mickel was not entitled to lodge an Appeal and accepts the submission made by Mr Bamber that the Stewards were correct in accepting an Appeal from Mickel.
9. It must therefore follow that he had every right to lodge an Appeal against the Decision of the Clerk.
10. It must also follow as a result of this Decision, that there has been no valid Hearing of that Appeal.
ORDERS
11. The Court accordingly directs that Mickel’ s Appeal be returned to a panel of Stewards to be heard in the in the appropriate manner, subject, of course, to Mickel wishing to continue with his Appeal.
12. Should he wish to pursue it, no further Appeal Fee will be required.
13. The Fee for this Appeal lodged by Tyler Read is to be returned.

8. This Court finds, in this particular instance, that the Clerk’ s Hearing related to“ cars being overtaken when they should not have been.” That is The Incident. Mickel was clearly part of that Incident and indeed the main complainant that an unfair advantage had been obtained by another competitor.
