Appendix 2- Schedule of Penalties and Who May Apply Them
7.10. A Licence suspended must be returned immediately to the ASN. Where a person or body holds only a digital Licence, the Suspension will be imposed digitally by the ASN and no surrender of a Licence is required. Where Suspension is imposed by the Stewards it shall be surrendered to them where possible, and forwarded by them to the ASN.
7.11. For breaches of App. 1 Art. 1.1 involving abusive language or behaviour, physical assault or threat of assault, the Clerk of the Course must hold a Hearing and publish a Decision, following which they must refer the matter to the Stewards of the Event.
7.12. For breaches of App. 1 Art. 1.1 and / or App. 1 Art. 1.13, the Stewards of the Event may, following a Hearing, impose a maximum penalty of a 30-day Suspension of the participant’ s Competition Licence where the offence is considered sufficiently serious, in accordance with Art. 3.2 above. The Stewards may also refer the matter to the ASN for further consideration, which may include referral by the ASN to the National Court. If the Stewards of the Event, after holding a Hearing, are satisfied that a contravention of App. 1 Art. 1.13 was of a serious nature, and the maximum penalty of 30 days is imposed, the matter may also be referred by ASN to the National Court, who may impose a further penalty.
7.13. The Stewards may refer any matter they consider appropriate to the ASN. They may not impose a 30- day Suspension for offences other than those under App. 1 Art. 1.1 and / or App. 1 Art. 1.13; however, such matters may still be referred to the ASN for further consideration of penalty. The Stewards of the Event shall consider the evidence provided and if the Stewards of the Event are satisfied there are such grounds they shall impose an immediate Suspension for a period of 30 days pursuant to Art. 3.2 of this Appendix and shall refer the matter to the ASN respecting Art. 7.10 above.
